Theuns du Toit, a student at the University of Stellenbosch (SU), was expelled from the establishment.
Du Toit, accused of racism, entered Babalo Ndwayana’s bedroom at Huis Marais on May 15 and urinated on his belongings. A recording of the incident went viral on social media and Ndwayana later filed criminal charges against him.
In a statement Thursday evening, the University said the disciplinary hearing ended on June 23 and that it strongly condemns any form of racism, discrimination or other prejudice.
“Human dignity is non-negotiable at the League and must be respected and supported. When such dignity is achieved, it must be restored in accordance with due process, the rule of law, and to the fullest extent that the constitution protects the rights of everyone in our country. There is no place for racism or victimization of any kind at SU,” the statement read.
The University said Thursday that the SU’s independent Central Disciplinary Committee (CDC) found Du Toit guilty of violating various clauses of the Student Disciplinary Code, one of which was that “a student shall not must not act in a racist, unjustly discriminatory way. , violent, grossly insulting, abusive or intimidating towards any other person”.
Du Toit was also found guilty of violating the Residence rules changed.
“These findings have led the CDC to conclude that there is no alternative but to expel Mr. Du Toit with immediate effect from the University.”
Du Toit has five business days to file a notice of appeal, against the CDC’s finding and/or sanction.
Commenting on the outcome, Professor Deresh Ramjugernath, Deputy Vice-Chancellor of the League of Learning and Teaching, said: “The University has taken this matter in a very serious light. This was evident, among other things, in the initial temporary suspension of Mr. Du Toit from the University while appointing Judge Sisi Khampepe to lead a independent commission investigation in alleged racism at SU. The University adopts a zero-tolerance approach to racism, discrimination, prejudice and behavior that undermines the dignity of others. SU management has taken note of the sanction imposed and will review the details of the CDC’s finding.
